Why (Clients / Potential Client)

As a photography business I will receive information from potential clients, clients, previous clients & 3rd parties as part of providing photography services.

Client information (including information related to the other relevant parties) will be primarily gathered stored and processed for the purpose of performing the contracted photography services.

Why (Linked Parties)

It is also expected that individuals who are not the contracted client there will be a legitimate interest for example where multiple parties are present in a photoshoot or given access where authorised by the client. This may also apply for potential clients. Where an order is placed this will create and additional contract for those Parties involved to enable fulfilment of this element.

Why (Children)

Note that while the services are aimed at adults and not for children directly, Children will be part of many of the photographs, and some of their details will be required to ensure that services are carried out appropriately and safely and details such as their names and ages will be gathers to assist with the these sessions.

Why (Linked parties part 2)

Many of the photography sessions will involve individuals other than the contracted party and as such there is a legitimate interest invoked for those who are included in any photographs, and those who wish to purchase any services/products of these products/services. The contracted party is responsible for ensuring that they have sufficient authority to exercise their interest and that they agree that any party provide the access details to purchase any of the images are able to do so without restrictions


The photographer retains full copyright and discretion on which contract, image(s), services, and parties can complete these transactions and retains the right to refuse to undertake any request.

Categories of Data

Basic Details including Contact Information, Event Details (Including other parties, may included ages (primarily for children due to the nature of the different photo shoots, suitability and safety requirements), Name, Address, Phone number, Email, Company, Website, Birthday, Who referred by, Payment Details, Social Media Contacts, Images and Galleries, Other Parties. Where you access our services via another route, social media or website they will have their own privacy policies and terms and conditions.

Data Sharing

The information is held by me as data controller to enable me to operate efficiently and to provide the goods and services offered it is necessary to pass some information where relevant to other systems and providers. For example my email, calendar, scheduler and account management systems, my photo gallery website, banking and payment services provider, my public website and if a physical product such as prints, albums the relevant supplier.

More Data Sharing

In addition there may be occasions where some information and or images may be share where appropriate with relevant my professional bodies, insurers and HMRC.

Copyright and Publication of Images

As copyright is owned and retained by Jenn MacKay Photography these images may be made available including social media, promotions etc unless agreed otherwise in writing.

Data storage

Jenn MacKay Photography selects which services and providers are used with due consideration to the different options available on the market and which are most likely to achieve the desired outcome. This means that some of the services will be based out with the UK/EEA. Where possible providers are selected where they participate in the EU-US privacy shield agreement.

Transfer of Data out with the UK/EEA

Currently none of the main professional photographer gallery websites suppliers are either based in the EU or participate in the formal Privacy Shield agreement at present. As a result full online galleries will only be available to clients who consent to their data being shared in such a manner.

Retention Policy

The information held and any associated images will be retained for only the period deemend sufficient for example, invoices and orders including contact details would normally be retained for a period of up to 7 years inline with HMRC record management policy.

Deletion Policy

Images may be deleted sooner however as the copyright is retained by Jenn Mackay Photography these may be kept indefinitely for the protection and use of Jenn Mackay Photography with no expectation that images are accessible to the client after your Gallery expires unless agreed otherwise in writing.

Your Data Rights

You have a number of rights under the regulations including, right to be informed, right of access, right to rectification, right to erasure, right to restrict processing, right to data portability, right to object & rights related to automated decisions.
Clients can view and update their information via their client portal or by getting in touch.
